Terms & Conditions
These Terms and Conditions ("Agreement") are entered into by and between Platte Clove Works ("Company," "we," "us," "our") and you ("Customer," "you," "your"). By visiting our website, requesting a quote, or engaging our services, you agree to be bound by these Terms and Conditions.
Please read this Agreement carefully. If you do not agree to these terms, do not use our website or request our services.
1. SERVICES
Platte Clove Works provides excavation and carpentry services to residential customers in the Hudson Valley area, including but not limited to:
• Site preparation, grading, and drainage work using mini excavator equipment
• Custom carpentry builds including decks, sheds, and handcrafted pieces
• Consultation and design services
All services are provided on an as-requested basis and subject to our availability and your approval of a written quote or estimate.
2. QUOTES AND ESTIMATES
Quotes and estimates provided by Platte Clove Works are:

Valid for 30 days from the date provided

Based on information provided by the customer

Subject to change if project scope, materials, or timeline change

Non-binding until a signed contract or purchase agreement is executed

Not guaranteed if site conditions differ from initial assessment
We reserve the right to adjust estimates if unforeseen conditions are discovered during the project.
3. PAYMENT TERMS
Payment terms are specified in individual project agreements and quotes. Standard payment terms include:

50% deposit due upon acceptance of quote to secure scheduling

Balance due upon project completion

Payment methods accepted: check, cash, credit/debit card

Late payments may result in suspension of services
-
A 1.5% monthly finance charge may apply to overdue balances
4. SCHEDULING AND PROJECT TIMELINE
Project timelines are estimates and subject to:

Weather conditions and seasonal factors

Unexpected site conditions or complications
-
Availability of materials and equipment
-
Changes requested by the customer

Other unforeseen circumstances beyond our control
We will communicate schedule updates and delays as soon as possible. Delays do not entitle you to cancel the project or withhold payment unless specified in a separate written agreement.
5. SITE ACCESS AND PREPARATION
The customer agrees to:

Provide safe and clear access to the project site

Identify and mark any underground utilities (call 811 before excavation)

Notify us of any hazardous materials or special site conditions
-
Keep the site accessible during scheduled work hours
-
Ensure appropriate insurance coverage for the property
Failure to provide proper site access or utility location may delay the project, and additional charges may apply.
6. WARRANTY AND LIABILITY
Our Warranty
Platte Clove Works warrants that all work will be performed in a professional and workmanlike manner, consistent with industry standards. We will address defects or issues brought to our attention within a reasonable timeframe following project completion.
Warranty coverage does not include:

Normal wear and tear

Damage caused by weather, acts of nature, or customer neglect

Modifications made by the customer or third parties
-
Issues resulting from failure to follow maintenance recommendations

Cosmetic variations in natural materials
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLATTE CLOVE WORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability under this Agreement shall not exceed the amount paid for the services in question.
7. CANCELLATION AND CHANGES
Cancellations:

Projects may be cancelled with at least 72 hours notice (for small jobs) or 7 days notice (for larger projects)

If cancelled after work has begun, you will be charged for work completed plus any materials purchased

Deposits are non-refundable if work has started or materials have been ordered
Project Changes:

Changes to project scope must be approved in writing

Changes may result in additional costs and timeline adjustments
-
Verbal agreements are not binding; all changes must be documented
8. CUSTOMER RESPONSIBILITIES
The customer agrees to:

Provide accurate information about the project and site

Ensure proper permits are obtained (unless we agree in writing to obtain them)

Comply with local building codes and regulations

Provide safe working conditions for our team

Not interfere with our work or equipment
-
Follow any safety instructions or recommendations we provide
9. PERMITS AND REGULATIONS
Unless specified otherwise in writing:

The customer is responsible for obtaining necessary permits
-
Platte Clove Works is not responsible for permit delays or denials
-
The customer is responsible for compliance with local zoning and building codes
-
Work will not begin until required permits are obtained
10. SAFETY
Platte Clove Works takes safety seriously. The customer agrees to:

Keep children and pets away from the work site
-
Not operate our equipment
-
Report any unsafe conditions immediately
-
Follow our safety instructions
-
Maintain appropriate insurance coverage
Platte Clove Works will conduct all work in compliance with OSHA regulations and industry safety standards.
11. MATERIALS AND QUALITY
Materials used in projects will be of good quality and appropriate for the intended purpose. If specific materials are not requested, Platte Clove Works will select materials based on industry standards and project requirements.
Variations in natural materials (wood grain, color, texture) are normal and expected. Minor cosmetic variations do not constitute defects.
12. PHOTOGRAPHS AND TESTIMONIALS
By engaging our services, you agree that Platte Clove Works may:

Take photographs of completed projects for portfolio and marketing purposes

Display project images on our website, social media, and marketing materials

Request testimonials or references about your experience

Use your name and location (with permission) in connection with project photos
If you prefer not to have project photos shared publicly, please notify us in writing before work begins.
13. LIMITATION OF USE
You agree not to:

Interfere with or disrupt the functionality of our website

Attempt to access or tamper with our systems or data

Harass, abuse, or threaten our staff

15. MODIFICATION OF TERMS

16. GOVERNING LAW
These Terms and Conditions are governed by the laws of the State of New York and the County of Ulster, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in Ulster County, New York.
17. DISPUTE RESOLUTION
In the event of a dispute, we encourage resolution through good-faith communication. If a dispute cannot be resolved informally, you agree to attempt mediation before pursuing legal action.
For disputes involving amounts under $5,000, small claims court may be an appropriate forum. For larger disputes, arbitration or litigation in Ulster County, New York courts may be necessary.
18. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will remain in full force and effect.
19. ENTIRE AGREEMENT
These Terms and Conditions, along with any separate written quotes or contracts, constitute the entire agreement between you and Platte Clove Works regarding our services. No other communications, representations, or agreements (oral or written) are binding unless signed by both parties.
